Municipalities should increase control over the costs of representation and fuel13.10.2015Municipalities of Kosovo have no written policies for expenses of representation or sufficient controls for fuel consumption. The largest Municipal Assemblies of Kosovo with law violations21.10.2015During the first nine months of this year, the largest Municipal Assemblies of Kosovo took decisions, in certain cases that were inconsistent with the provisions of the applicable laws. During this period of time, based on the assessments conducted by the Ministry of Local Government and Administration it appears that two breaches were identified in MA of Gjakova, while one legal breach was identified in each Municipality of Prishtina, Prizren, Ferizaj and Gjilan. Meanwhile no violations were identified in the Municipality of of Peja and South Mitrovica.

Progress Report confirms the need for increased transparency in Kosovo Municipalities12.11.2015The European Commission Report on Kosovo for 2015, once again highlighted the need for the local government level to increase transparency in decision-making, which is consistent with the constant calls of civil society in Kosovo. Law violations in neighbouring Municipal Assemblies of Prizren25.11.2015Neighbouring Municipal Assemblies of Prizren, during this year, in certain cases, have made decisions that are not in accordance with the legislation in force. Based on the assessments of the Ministry of Local Government Administration, it can be noted that in MA of Suhareka, Malisheva and Rahovec are evidenced legal violation, one violation each, whereas in MA of Mamusha, Dragash and Shterpca were not evidenced such cases.

Major municipalities in Kosovo with less property tax revenue16.12.2015The nine-month financial report for the budget of the Republic of Kosovo, drafted by the Ministry of Finance, highlights the fact that almost all major municipalities in the country had a decrease in property tax collection. An exemption is only the Municipality of Prizren, which managed to collect more property tax revenues compared to the same period of the previous year.

Treatment of constructions without permit within Protective Zones13.06.2014Days ago, the Ministry of Environment and Spatial Planning has released the draft of Administrative Instruction on Basic Health and Safety Requirements for Treatment of Constructions without Permit, pursuant to the Law on the Treatment of Constructions without Permit, which is in effect from 5 February 2014.
Regarding the Law on the Treatment of Constructions without Permit as well as the aforementioned Administrative Instruction, we do take this opportunity to caution about certain aspects concerning the architectural heritage and protected zones. According to Article 12, section 2.7 of the Law states, inter alia, that, “Inspections of unpermitted construction should determine that the Applications for legalization shall be refused if, after inspection, the competent body finds it is built in the protected zones and special zones of cultural heritage.”Download

First steps on the mapping of structures built without a construction permit in Pristina12.05.2014As part of the “Online Transparency of Pristina Municipality” project, EC Ma Ndryshe, in the opening months of this year, has developed and tested a methodology for identification and mapping of structures built without construction permits. The primary objectives of this methodology were the on-the-site scanning of constructions, identification and recording of violations and graphical presentation of their expansion on the map. Municipality makes double payment of an invoice for maintenance and repair of the Mayor’s vehicle06.09.2013On the Audit Report of the Office of the Auditor General (can be downloaded at http://www.oag-rks.org/repository/docs/RaportiAuditimit_KPZ_2012_Eng_36581.pdf) it is noted that, “Municipality made expenditures with no contract and without procurement procedures for maintenance and repair of the Mayor’s vehicle, in the amount of €3,977”, expenditures that relate to periods from 2008 to 2012. Moreover, this state authority has also encountered a double payment of the invoice by the municipal budget. “We reviewed these payments and noticed a double payment for the invoice 1892/S in the value of €336. This invoice was introduced in the invoice summary No. 001 dated 10.04.2012 and also as a separate invoice dated 12.12.2011”, states on the OAG’s Report.Download

As of next year the Sports Centre to prohibit the setting of the amusement park29.07.2013Concerns about this issue have been raised by different groups of citizens at the meetings which EC Ma Ndryshe has held with various groups of society as part of the project “Inclusive City – Participatory planning for sustainable urban development in Prizren”. Women and senior citizens living in the quarters nearby the Sports Centre have complained that the placement of an amusement park has violated the peace and quiet of residents living in these areas. They have pointed out for noise pollution going on far into the night and citizens are being denied from leisure time in the greenery of this Centre.Download

To end the practice of collecting money from schoolchildren15.07.2013Over the past months EC Ma Ndryshe has received individual complaints from parents and schoolchildren about the money sought from the management of public schools in Prizren for the payment of security, maintenance, repairs of sanitation or for additional payments. Evidences of urban degradation in Prizren17.07.2012EC Ma Ndryshe has continued to oversee the work of municipal executive during the month of July. In this period, the focus of oversight had been set on the sector of urban planning and the constructions within the Historic Centre of Prizren. Just in the first six months of 2012, the Institute for Protection of Cultural Monuments in Prizren had issued 62 consents for constructions or interventions within the Historic Centre of Prizren. It is disturbing that a considerable number of constructions do not follow the original project designs and the construction permits issued by the municipal authorities. Although do not retain any obligation whatsoever for proceeding requests to the Directorate of Inspection, this Institute, in the past three years, has sent over 25 requests for ceasing the construction works or for demolition of those constructions for non-adherence to the project in line with the consent issued by the Institute and in accordance with the principles envisaged for cultural heritage in the Historic Centre of Prizren.Download

We are deeply alarmed that the findings of this report indicate the incapacity of Prizren Municipality for good governance and transparency when it comes to public money. Poor management of the school budget and flawed healthcare services14.06.2012EC Ma Ndryshe continued with the oversight of executive branch of Prizren Municipality in May as well. What is worth pointing out is that the decisions (conclusions) of the Mayor of Prizren Municipality, brought in May 2012, have not been released on the municipal website. This fact clearly indicates the lack of transparency of municipal executive in relation to citizens. EC Ma Ndryshe requires from the Mayor of Prizren Municipality that the doors of his meetings with the directors of directorates (Board) be open for civil society and the media, in order to increase transparency in decision-making by the municipal executive. The Mayor of Prizren Municipality without a Work Plan05.05.2012EC Ma Ndryshe expresses its concern regarding the lack of the Work Plan from the part of the Mayor of Prizren. In our application addressed to the Mayor of Municipality to grant us access to the Annual Work Plan for 2012 and for decisions taken since the beginning of the year 2012 and the manner of publication of the decisions brought by the Mayor; we have received a reply from the municipal officials stating, “You may find the Mayor’s Report and his decisions (conclusions) in the website of the Municipality of Prizren.” Download
Prizren Municipality in hardship with transparency of its executive branch16.04.2012Pursuant to the Law on Access to Public Documents and municipal Regulation on Transparency, non-governmental organization EC Ma Ndryshe has submitted application to the Mayor of Prizren, Mr. Ramadan Muja, Directorate of Education and Directorate of Health. The application, as such, was filed on 02.04.2012, bearing a protocol number 01/031-3411; in which the cabinet of the Mayor of Municipality was requested to provide us access to the Mayor’s Annual Work Plan for the year concerned.Download
